“Samsung’s infringing sales have enabled Samsung to overtake Apple as the largest manufacturer of smartphones in the world,” Apple wrote in the filing. “Samsung has reaped billions of dollars in profits and caused Apple to lose hundred of millions of dollars through its violation of Apple’s intellectual property. Apple conservatively estimates that as of March 31, 2012, Samsung has been unjustly enriched by about [REDACTED] and has additionally cost Apple about $500 million in lost profits.”
For Apple to be happy they are asking for $24 per unit for “design patents or trade dress rights.” They also want $2.02 per unit for the “Overscroll Bounce” patent, $3.10 per unit for “Scrolling API” patent, $2.02 per unit for “tap to zoom and navigate.”
On the other side, Samsung has been demanding a 2.4 percent royalty rate for their standards-essential wireless patents. Cupertino says that rate is far too high and the amount should only be $0.0049 per unit. Stating that the royalty fee should be based on the baseband chipset cost instead of the devices market value.
