Preliminary ruling says Apple didn’t violate Samsung Patents

Before you all go and get your feathers in a ruffle, let’s be clear here. This is a preliminary ruling by an Intentional Trade Commission judge for a case that has been open for over a year. This has nothing to do with any filings by Samsung for Apple iPhone5 bans for use of LTE patents. The preliminary ruling was in favor of Apple which covered patent infringement claims by Samsung for Apples use of 3G integration, transmission of data packets and integration of web surfing. It was aimed at the iPhone, iPad and iPod touch. Samsung plans to contest the verdict and keep pushing forward.

This case isn’t over though. As mentioned, this was a preliminary ruling. The full commission will be meeting in January to decide if the judges preliminary ruling will stand or be changed. As always, Apple also has an open case going after Samsung for violating several other patents as well. Let us not also forget that Samsung should be filing yet another patent claim against Apple for 4G LTE technology, much like HTC has just done.

The whole thing is just a back and forth battle. While a lot of us would like to see Apple get nailed to the floor for something, it is going to be a tough battle. Personally we’d rather see all parties involved just drop it and move forward. We will keep our eyes peeled for any major developments that award or punish either side. At least we know there won’t be any lack of cases to cover.
